‘Disappointing’ judgment underlines importance of leader liability insurance

A French judge’s ruling against a Ski Club leader this week underlines the importance of leader liability insurance for anyone leading in France, says Michael Pettifer, Managing Director of MPI Brokers.

Reacting to the €10,000 fine – and damages of €1 in favour of Ecole du Ski Francais – imposed on the Club’s leader, Ken Piddlesden, Michael Pettifer says: “As a Ski Club member and Rep for over 40 years I am hugely disappointed at the outcome of this case. It suggests that all ‘leaders’ are now at risk – irrespective of whether they are paid or not.

“The French Code du Sport requires people to have a qualification to instruct, lead or guide skiers ­– if remunerated. This case seems to extend the law to everyone.

“This is a turning point, so any volunteer or even someone on holiday could be caught by this new interpretation of the law. Now, more then ever, it is important to have Ski Insurance with leader liability cover, as provided by MPI Brokers.”

Ken Piddlesden was stopped in Val d’Isere in April 2014. The Club is reportedly lodging an appeal to the court and a complaint to the European Commission.

In France this winter the Ski Club introduced the ‘Ambassadors’ concept, which is now being used by tour operators alike. The Ambassadors do not ski with guests, but help them plan their day. Ski Club leaders continue to work in Switzerland, Austria, Italy, Andorra, Canada and the USA.
